Student Visa is required ??

Please Advise..

Thanks in advance.

Yes .. one can study on EAD.

However, some old folks at some remote univ/school might not be aware of this rule and you might have to jiggle a bit (especially after 911) to make them understand the rule ( keep in mind that one also gets EAD after school w/ practical training)

Based on my understanding, the moment you file your 485 and get the Receipt Notice from INS you're IN STATUS, i.e., status as an alien waiting to adjust status to a permanent resident. The EAD allows you to work for any employer in the US, and Federal and state laws prohibit employers from discriminating against persons holding an EAD. If any employer refuses an EAD and denies you work, you could sue them. Anyway, coming back to the subject, as far as I know there shouldn't be any problems but you might want to check with your lawyer or INS whether your wife can join school in your current status, i.e., 485 w/EAD.

While all the abover responses are correct, jsut wantd to clarify that:

- EAD is for employment, nothing to do with studies.

- If you are thinking whether you can get any remuneration from the Univ/College or not, yes, you can, using EAD - not H4.

Note that once you use EAD, you are no longer on H4 and if you are planning a visit abroad, you must have AP to come back.
