Does anyone know if I can accept an overseas assignment while 485 is pending? I am using an EAD currently and an overseas assignment has opened within my same sponsoring firm. Can I use an AP to travel if the assignment is less than 6mos? less than 1 year?

Any insight would be greatly appreciated. Thanks in advance.

Thanks Jaxen

Jaxen, Thank you for your comment. I was under the impression that under 485 one has to stay at the same location as filed originally on I-140.

So if I can keep renewing the EAD and AP, I can actually work at an overseas location? Would I need to file an AC21?

Yes you have to work in the location mentioned on your application, but that is applicable if you are working in US.

You don't need EAD to work outside US. But, if you have to come back to US and work (even for a day), you need EAD.

You need AP to be able to travel in and out of the country. As far as I know you CANNOT renew your AP while you are not in US.

I guess the question you should be asking is, whether you are still eligible for Adjustment of Status if you are not in US. The answer may depend on the length of your assignment.

No problem.

My GC was approved while I was visiting my home country. When I came back with AP, only question asked was if I was still working with the same employer.

what about if you are on H-1B and I-485 is pending

What if it is an extended assignment?2-3 years
What happens if I-485 is approved while you are away? how do you come to know your I-485 is approved?
