Can My Wife Start Own Business On Ead?

My wife is a Derivative ( I am the Principle) and was on H4. We recently got our EAD. My question is - Can she start her own Business? Will it affect my GC process in any way? Thanks in advance.

Yes your wife can incorporate her own firm.

That said, here is something you might want to consider - you may want your wife to work on a 1099 (Sole Proprietership) basis. This basically means you have no employees - and saves you some of the overheads associated with incorporating a company. This option is particularly useful if all you want is for your wife to go independent and not take on additional employees at this time. Talk to a CPA on this!!!

This is NEWS to me! I thought if she is on EAD, my H1 is still valid as I am still not using my EAD. Gurus, Could someone throw more light on this issue??

shama is wrong. check www.usvisanews.com faq sectino. you can start a company even with H1 as long as you do not take income from that company.

if your wife uses EAD, and if you work only for your petitioned company you can still maintain your H1.
