Can Kenneth White ask DOS/KCC for a full disclosure of previous years?

well, If some anonymous internet forumers can get a hold on this, I'm sure a lawyer would
There is a guy who claims to have used the signatures of dates of application from a Russiam forum.And guess what?22% off the winners were from the last days.
Even in this forum just check out the signatures of last years winners dv 2011 you will spot the pattern.
So Im sure if Mr.White gets hold of the previous results he will have some strong points and evidence about the issue of randomness.
 
Well, one thing I noticed on this forum is that recently peoples have started to believe something will be done between DOS & Mr White while not long ago, only former selectees believed in it while non selectee were mocking them...
July 12 will answer this.
We should wait till July 12th, Don't rule anything out. There is rumor going around that they might reinstate all May 1st result. Meaning the 22k and the remaining 78k that has not view their result on ESC before the technical error. So non-selectee don't get your hope so high.
 
Yes, he can ask for that during discovery--(motion for disclosure of documents and things). As long as he can show that those documents are relevant to support his claim and the documents are not privilege.

Refer to Federal Rules of Civil Procedure 26.


Well, he can ask about everything he wants to, but it doesn't mean that somebody has to reply on that. You guys just keep forgetting about that previous DV programs already took place and everybody were happy. KCC doesn't have to keep previous DV selection programs either keep the statistic about it, it was the first time they found out that results were weird. :cool:
 
KCC is not camdem town market.. everything is in "order" & kept for the record so DOS has all entries even from 1995...

1. The lawyer can not ask for everything--He can ask for ONLY documents or things that are RELEVANT to support his claims. Refer to FRCP Rule 26
2. Regardless of how previous DV went, whether it went well or not; or whether people were happy or not; the lawyer can ask for those documents if it is relevant and DoS has previous DV in their records
3. The court can ORDER DoS if they fail to produce those documents and under certain circumstances SANCTION them. Refer to FRCP Rule 37

Boy... What is the purpose of a judge authority then?
It would be too easy... A judge ask for some files but since it is "private", the defendant won't give it without risking anything...

Corewin: I understand what you are trying to say. It is called "PRIVILEGED INFORMATION" eg are trade secrets, lawyer's work product, executive privilege... etc

However, I dont think that asking dates of appplication or previous DV does not fall in the exception of privileged information. Also not that this is asked during DISCOVERY...
