Can i work as a independent contractor ?

Hi

I have EAD and Applied my AOS 4 and half months back, After one and half month that is past 180 days can i work as a independent contractor.

Currently i am out of project ,so not getting paid by employer.
Good thing is he won\'t inform to INS ,but will try to get a project
for me.

I am thinking of using my EAD and get a job ,if i didn\'t get one in next one and half months,Can i work as a independent contractor ?
Is there is any risk since i don\'t have pay stubs for this time

Thanks

Jim Mills.. can you please explain if this is possible?

Can I ask you something first???
U said you are not on project and you are not getting paid.... so then why do not you ask your employer to lay you off.. in that case you are free to do anything even before 180 days..if not i think you can tell INS about this as this is illigal .. and if he want you to stay with him ask him to pay ir-respective of project.. as it\'s not your fault and he had earned hell a lot on you???????

What other guys are thinking on this?

waitingapproval02 & gclucky1,
Here are some of my observations...I am on the same boat like you and so they may not be accurate...

1) I don\'t think you can continue your gc if you are fired before 180 days. So, I disagree with the suggestion of gclucky1.

2) Even after 180 days, you have to find some employer to continue GC...i.e. you have to get a letter from new employer that they are ready to continue with the GC. So, after 180 days, the significant difference is you can change the employer and nothing else.

3) With EAD, even now you can work as Indepent contractor...but only thing is that your current employer should be ready to continue your GC. After 180 days any employer can give you the offer letter.

So, please let me know if I am wrong,

thanks,
raju

Thanks Raju !!

Your posting is quite informative.. as i said.. i was not sure about my posting.. that were my questions as well.. so thankgs..

1099 or W-2

My case is also similar to Raju\'s. I have a question, If you just got EAD and your GC approval is still pending, can you work as an independent contractor on 1099, or should one be on W-2 with the new employer?

Thanx
