now if i use pre aproved lC can i asked any document/reciept from company for my record .Any proof that i can get from them about aproved LC

Well you can ask a copy of Labor Certificate... Also when they will apply for I-140/I-485 you can ask for BCIS receipt

hi gp11

thanks
now if they r ready to give me aproved LC. There will be my name on aproved LC ?
What papers required for filling I-140/485 concurrent ? Can i have check list for paper what i need at filling time?

1 You can use approved labor certification if your Education Exp was the same before the date that LC was filed. You cannot use Experience gained through H1 with the current employer.
2. Get the original approved LC that was sent by DOL to Lawyer or employer and make 2-3 copies from that original, then meet some good lawyer, show your Educational evaluation, past work experience letters, resume. Then he will evaluate looking at the approved LC and your education, Skills and experience if you are eligible to use it. It is not easy to make guess because nobody in this forum has seen the LC that is with your employer. Most important part to look is on ETA750A Form in column 13, 14, and 15

3 if the lawyer is confident that your education match with the LC and you had these skills, required education before LC was filed then he will advice you.
4 For I-140 filing you need all past exp letters, education evaluations, degree certificates, transcripts and approved LC. I-140 has to be filed by Employer NOT by you
5 If lawyer advises that you are eligible for Labor substitution he will provide you list of documents for I-140 and I-485 filing. You can file I-140 and I-485 concurrently.

You can visit www.immihelp.com and find the list of documents under AOS or I-140 filing

Guys,
This is my situation. I am on a H1 with company A. Company B has an approved labor with Education/Experience matching with my profile. I got this evaluated by a lawyer and he says its a perfect match and I can go ahead with substitution. I want to file I140/485 without getting into Company B payroll. Lawyer says it is OK. I wanna listen to any comments from you guys.
Did anybody filed I140/485 on a labor substitution without getting on to other company's payroll and how does it worked for them.
I appreciate your comments.
thanks

YES !! you can file . There are lots of guys filed like this and they got EAD and their processing is gonig on .. Dont worry .. you can goahead .. and you dont need to be in Company B payroll .. But it should be a good idea to go in to Company B payroll once you get EAD ..

Thanks
