Can I use EAD for a part time job?

Have been on 485 for more than 6 months and am looking at the option of working as a part time using EAD. Does one has to inform the employer about the part time job or is it not required. While using the EAD for part time... is it the best option of going with 1099. Appreciate any input in this regard. Thank you.
 
u can work anywhere anything but only part time (10 99 tax )

U can work part time and do any work . not required to inform employer. but only thing is that U have to keep Ur main employement with the employer u filed I-485. other wise U should have one job as mentioned in Ur labour certificate and exercise ur EAD and work anything anywhere . Part time job will be on 1099 and ur main job will be on W-2.

I am having situation like this. I am on bench since long and my employer is asking me to look for job with another company but he will continue my gc. Can i go on unpaid leave with my gc processing employer and work with other employer, what status should i work on like W2 or 1099 ( With other employer), and if possible please explain diff betn w2 and 1099

The diferrence between W2 and 1099 is how you pay the taxes. With W2 the taxes are cut by the employer in your paycheck. With 1099 they do not cut taxes. You have to pay the taxes separately to IRS. For e.g you get a 1099 from your bank at end of the year for any interest and you have to pay tax when you file your taxes.

I would recommend taking a part time employment on EAD but to take the W-2 option rather than 1099.

Amar: It is OK for you to go on EAD to work for some one. However if you do not get pay from your sponsoring employer you may be in a spot if you receive an RFE for pay stubs at time of approval. You really cannot show pay stubs from part time job. However you need to survive so you can take up the job on EAD to pay your bills but try to get into company payroll as soon as possible.

Also if your employer is going to help you when the RFE is recd the lawyer can always say they will start paying you once the G.C is approved. However there is risk involved as the INS can become suspicious with the break. But a good lawyer maybe able to argue the case successfully.
 
So if new employer ask me to work on w2 should i go.

Hi vivek thx for explaination. My sponsoring employer is asking me to go but on a condition that I should return to them when they need my services. So if i take shrt time job with other company on w2 and come back will that be ok.

Amar:It should be. Make sure you work as a part time employee with the new employer even if it regular 40 hours per week. Normally that should not be a problem and they(new employer) should be able to help you.

However try to get into your sponsoring employer\'s payroll ASAP.

What are your RD and ND dates and which center did you file? You should have an idea which dates the center is processing and when they will get to your file from this great site. SO accordingly be ready with 3 months pay stubs.

These days vsc is processing march cases. I think by April my turn should come. I am still on sponsoring employer\'s payroll and getting full salary on bench. But I am not sure till how many days it is going to keep me like that, that\'s why I am little bit nervous. thx

In that case you are most likely OK. I think the INS has some mechanism to determine how much taxes you had paid to a particular point. You have been on salary so far and if you get another job you still will be paying taxes. I assume you had sent your pay stubs when you filed 485. So if everything else was in order INS may not even send an RFE. I think they send RFE for pay stubs when they are not certain you are getting paid currently. I am just guessing here as they do approve lot of cases without RFE.

Being on sponsoring payroll is always safe. It maybe OK to work on EAD in your case if they stop paying you on bench as you need to have some income coming in.
 
Spouse can work..

for any body if she has ead card. My friend\'s wife is working full time after getting EAD(she is dependant).
