i applied for asylum in 2004 and got my gc in 2009. its been 9 years since i have seen my parents and siblings, and recently my grand mom has gotten really sick. so i m planning to go to cop for 3 weeks. i am told by uscis that i can travel but i need a reentry premit and flying documents to go back to cop. now my questions are if someone can help by answering them, any tiny bits of info will be gladly appreciated.
1) is traveling on re entry permit safe?
2) has any asylee had traveled before to their cop on green card?
3) will there be an issue when i go for citizenship interview?

trust me that you are increasing your risk of being denied citizenship if you apply or even may be be revoked from your asylum.
1. But its still possible to go back but a problem is that if re-entering the US ,at the aiirport they will place have to ask you where you went to and which country was your country of persecution ,all i can tell you is that you say ,your truth because you cannot lie them.I understand you that your grandma is ill and for anyone he will want to do the same as you ,but what you need to also understand is that you will just be playing with a lot of risks of not entering back,so that's what you need to first know.
2.no the best way to travel back is when you are a US citizen ,because at that time the US is able to take responsibilities if something happens to you in COP and as a citizen ,you have all the rights just as a newly born citizen. So if you can wait and be a citizen ,then fine.
3.yep ,this is definitely where all your travel records will come up ,because they will study all your trips ,your background and many other things ,i haven't applied for it but i have read a lot of procedures they do ,but i bet you that this will be that final step and they wont let anything pass off their eyes.

Please i understand that you grandma is really sick but you will also be playing with your life by going back home ,but as a friend ,i will tell you to do what your heart really wants to do and remember that if you want to re-enter the US ,i will advice you to have a lot of proofs that will show everything you went to do over there and pls dont stay for long ,sometimes the immigration will live you re-enter from what i heard but provided you have very powerfull and sufficient reasons .Good luck

Also i wanted to add that ,if you received your green card on 2009 ,then assuming you had your asylum in 2008 ,then it mean this 2012 it would have made 5 years since you received your asylum ,meaning you were suppose to have applied for citizenship right this year ,but why haven't you done so??? or may be you dont want to lose your citizenship, then that's fine. But i just wanted to let you know that you could apply for citizenship this year.

thanks for you reply gladly appreciated. i understand what you are saying ill do more reseach on this issue. i really want to travel back but i dont want to ruin my life. i have nothing to do with cop other then visiting my family since my mom does nothing but crying cuz she miss me. and its vise versa. and i got my gc on 2010 actually, just check the date and issue date is dec.12 2009, so i have almost 2 more years left. wait i heard i can apply after 4 years and 9 months ? is that correct..?

You can apply for citizenship 4 years and 9 months AFTER you permanent residency was APPROVED, not when you applied. So for you you can apply for citizenship in September 2014.

First let me show you how to calculate it..The year you have been approved asylum is already starting to count as a year until you apply for your first green card. That means if you were approved asylum in 2008,and then received your green card in 2009 ,then it means 1 year has passed since your asylum approval ,meaning you are left with 4years to apply for citizenship,so now that we are in almost 2013 ,it means fom 2009 to 2013 ,4years will have passed ,which will total 5 years altogether.that is from 2008 to 2013 is already 5years gone ,so you have to apply for citizenship by december of 2013.Hope it makes sense

asylum after one year ban

hello good people,i hope you'll be able to assist me with what is eating me. i'm a gay man from south africa who came to the US in 2009. back home i suffered a lot of homophobia & it is evident on my body as i have a lot of scars from beatings. i have been very sick over the years & have been receiving treatment & also i have been seeing a social worker who has proved that i have post traumatic stress disoreder & now my question is that reason good enough for me to apply for asylum after the one year deadline or im putting my life at risk.help me please. suppose i do how long will i have to wait & will i be able to travel abroad in case i get approved. what are the chances of getting approved after one year or i should just drop everything. thank you all who will help

leeroy,

Although there is documented homophobia in South Africa, in my opinion it is not government initiated nor does it meet the levels required to prove persecution so your chances of getting asylum on those grounds are slim to none and slim already is out of town, sorry.

Homophobia in SA is not above and beyond that found in other African countries. Uganda and Zimbabwe have way higher levels of homophobia.

Your other questions are moot since you will not get approved.

Cheers.

That is not correct. The persecution doesn't have to be government-sponsored or initiated. Thousands have successfully obtained asylum in the US for nongovernmental persecution, such as fleeing from female genital mutilation, or being persistently attacked for their religion or sexual orientation.

First I will have to point out that what ever thing we say in this forum is not legal ,but we are just trying to give you advice .
Concerning your question ,it depends on many factors before applying after the 1 year deadline and as you too know here in America ,the law is complicated so i will advice you to look for a lawyer ,tust me its fo your own good because we here we cannot give you exact and specific answers ,to get those answers and be assured at 100 percent ,it is by hiring an immigration lawyer in this case. Also there are organizations out there that offer free legal advice to people ,so yu can just check out if there is one in your area or look for one else by calling them and explaining your situation .That been said ,that really how i can help you ,to have specific answers to your question consult an attorney.Hope i help you

Unless you apply for citizenship as the spouse of a US citizen, you can only apply 4 years and 9 months after the "resident since" date on your GC. I would advise you NOT to travel to Pakistan until you become a US citizen.

wait i heard i can apply after 4 years and 9 months ? is that correct..?
