I am in a bit of a quandary. My interview for my family based petition was finished in Aug 2006 and my priority date became current about 3 months back( Jan 2001 ). But my application is stuck in Name check/FBI check, one of those 2 never ending black holes. My company, assuming that it be possible that my application is not approved(since the actual GC or the approval hasn't come yet), has applied for my seventh year extension, and that is still in process. Through my family based petition, I have already got my EAD and Advance parole.
Now I am in the middle of thinking of taking a new job. I would like to take a week off before I join and go out of the country before I start the new job( very less vacation in the new job). I asked my current company lawyer and they said its advisable that till your H1 extension is in process, not to leave the country. I did mention to them that I already have advance parole document. Obviously my current employer doesn't know that I am thinking of leaving.
Is it really true that inspite of the advance parole document, I cannot leave the country? I find it surprising that the lawyer( a big national law firm) would advise against it.
This forum has really helped me in the past I am hoping for some comments/directions here.
