Can I travel back into US on visa from Company A while working for Company B

I need some information on re-entry into US on a old H1B visa. I was working for Company A earlier and had a valid H1B from them and got the Visa stamping done from washington for Company A. The Visa is still valid upto May 2001, and I am planning to visit India in Jan, 2001. I am working for a different firm right now and I have H1B from this company, but do not have the visa stamp in the passport for these people. Can I travel and come back into US using the old visa with the new H1B petition?

I have been getting mixed responses on this and I am not clear as to do what? Some body told me that unless the visa has been revoked I should be fine and should be able to enter us on this visa.

Can you tell me if I can do that and also, if how can i check that my old visa is not revoked and still valid.

I am in exactly the same position as you are. My lawyer told me that I do not need to go to consulate again. But, I\'m not so sure. It\'s just better to go and get another stamp. Btw, have you already started your green card process? Cos\' on the visa form OF-156, they ask you whether you have applied for Labor certification. I don\'t know whether saying yes affects your chances of getting a visa. Would appreciate if you have any info. Thanks.

I just got some info:
Technically, you could be required to change visas every time you change
employers with new INS permission. However, several months ago, the State
Department came up with a strange opinion. They said if an employee changes
from employer "ABC" to "XYZ," then a new visa will not be required. But the way
I read that decision, it also says that if ABC ever cancels the employee\'s H-1
with INS, then a new visa would be required.

The strangest thing about this opinion is that ther is NO way for either the
State Department or the employee to keep track of when H-1 has been canceled.
Therefore, implementation of this decision is impossible. Accordingly, you
should not have a problem even if you did not get a new stamp.

To stay on the safe side, however, I have recommended following solution.

If in U.S. and employee\'s H-1 visa has not expired for over a year, send it to
Washington DC office of the Visa Services (DOS) for extension/change.

If abroad, go to the US consulate and apply for a new H-1 visa.

In both the above cases you should be told that you do NOT need a new H-1 visa.
The advantage of this approach is that we have tried our best to comply with an
impossible directive.

In July 1997 there has been a decision reached by INS/DOS that they would not
require new visas, but the decision still does not address the cancellations
situation. So the above advice still holds good.

Nevertheless, I must confess that out of thousands of cases we have seen in the
recent months, there has never been a sitution where an old visa was questioned
by INS. So YOU DECIDE.

I am not sure what to do, I am trying to get some info from somebody who has done the same.

Hi. I was working for Comapany A when I joined Company B. My H1 was tranferred to Co. B. I had to travel to UK for orientation. Company B\'s lawyers said I will have to get my passport stamped with new visa so I called US consulate in London for an appointment. After ascertaning my position the consulate in UK said that I do NOT need a new stamp as long as I am travelling with valid documents, the new H1B papers now. That is what I did, showed the papers to the airline guy at London airport and the INS upon arrival. This was 2.5 years ago....

Hi,
I have a sligtly different question. I was working for comp A from 1998. I had visa vaild upto May 2000(date on 1-94). In June 1999 I moved to company B. I have not got my visa in the passport stamped though I have the new I-797 with the 1-94. I ma now planning to move to company C. My H1B visa will be filed in a few days. My question is that should I get my visa stamped with company B in the passport so That I do not reach my limit of (1-94 date + 1 year) before the may 2001 deadline or should I wait till I join company C and then get my visa stamped for company C.
any thought will be really helpful.
