my attorney is giving me different messages. First was told that i cannot travel before receiving h1-B receipt notice. Subsequently was told I can travel. I do have my H1-b which is still valid till year 2004. Please advise if anyone is in the same situation.
If the H1 is with your sponsoring employer, you can. You should have a previous H1 stamp in the passport.. Just show the H1 stamp + I797 to the POE. If you can get a new stamp (if the travel is to your home country or canada or mexico) you can show that too.
INS site has specific information about non-requirement of 485 receipt for people on H1 in its FAQ section...
