Can I transfer to F1?

Hello,

This is my situation: My husband and I are in the I485 stage and passed 180 days. However, he was laid off and now is looking for a job. I am currently studying in a local university. We worry that I485 may be rejected although we know that we can use AC21 as long as he can find a similar job. But we want to prepare for the worst case scenario.

Since I have the admission for the school, can I transfer to F1? If not, why? If yes, when will be the best time (now or wait until we get rejected)?

Thanks for any advice!

yes, but all 485 applicants get a notice to deny 485. that is the cue for you to apply for F1

Thanks jaxen. So you are saying that I should wait until after I get the denial of I485 (if it happens), then apply for F1? Wouldn't I be out of status then?

I think you can try to apply for f1, but then as you already applied GC, it would be conflict in intention, your f1 might get rejected.

So I think as Jaxen suggested wait for intention to deny letter (before I-485 denied actutually denied, it's like REF, so you will have chance to reply or contest at that time also)

Don't think about deny or other negative thing, just start look for job and get similar job ASAP

Other idea to get h1 for you, if you can find sponsor employee, then h1 has duel intention, and there won't be conflict in intention.

I hope this help.
