Can i transfer my H1 B on I 797B petition

URGENT! Need help regarding transfer of H-1

My H-1 was approved on Sep 2006 and received I-797B, but didnt receive
I-94. While filing for H-1, I was on H-4 visa and and never out of status. My status is not changed as I have not received I-94 and so still on H-4. My petition says that I have to get my passport stamped before start working.

My consultant has filed amendment three weeks ago for changing my status, still didnt here anything.
I want to transfer my H-1 to another consultant as my current consultant is not responding properly and also not good in placement for jobs.

I dont have any pay stub since I am not eligible for work.

Plz inform me about chances of transfer and whether my current consultant will come to know about it?

At this point of time your approved I-797B is not tansferable, unless you go out and get your visa stamped and get your I 94 with caveat H1B.

Otherwise your amendment request must get approved by USCIS and get your I 94 caveat H1b before you transfer.

How much are the chances for getting my amendment approved? How long usually it take for getting my change of status amendment?

If a person asks for approval of an h-1b and a change of status and uscis only approves the h-1b without an I-94 card then they issue a split decision.

In the split decision they detail why they didn't approve the change in status.

If you want assistance then please give details of the split decision and why they didn't grant the change of status.

They have not mentioned anything of split decision. The I-797b is similar to those issued to one applying from outside US. My friend has also faced similar problem but he is on F-1 status.

Also I have never been out of status
