I am USC and my wife is from Jamaica, we got married on June 29th 2005. We are getting ready to send in our paper work, and some things have come up. I work 2 jobs, and make about $30,000 a year before taxes. But I pay most of the bills while she has been saving for sending in the paper work and paying for the doctor bill for the us surgen to fill out the forms they have to do. She only wroks about 3 days a week, sometimes more sometimes less.
Well about 2 months ago my check started to get garnished and they are taking 25% which is killing my pocket. I am starting to run behind on some of my bills, because they are taking about $110 a week from me. I also owe the irs about $12,000 but they agreed to just keep my tax return every year until it is paid off.
Questions:
1. If I file bankruptcy to stop this garnishment, will that stop us from getting through this process?
2. With me owing so much to the irs will that stop us?
3. Should we wait until the garnishment stops before we try to file? I owe $2,400 and they have taken about $800 so far, and they are taking about $110 a week.
4. Her school status runs out in January 2007, she is pregnant and due in late September. Our child will be a usc when she/he is born. Will that make it easier for her to become a usc?
