Can I start GC in company B while working in A or company C.

Hi Guys,

since i am a newbie for GC process i would like to explain my situation and advice from gurus.

currently i am working with company A and applied for LC (hope will be cleared in 6 months), mean time, my boss is becoming worse, he started laying off employess, pay cuts and asking all the fees for processing GC. he won't terminate me atleast for another 6 months. because i have project until then. but anyhow he is going to terminate me afterwards. i dont want to wait that happend.

here is my question,

is that possible i can start GC processing with company B while working with company A, later i can join with company B, say in between processing of GC or join with company C and still processing GC with B. so that i am not wasting time.

your advice will be greatly appreciated.

You can do both

1. Join B after A
or
2. Join C after A and let GC continue with B. Join B however once LC is done - for good measures.
 
I've a question related to your 2nd point.

2. Join B after LC is processed:
a. Does joining means to be on B's payroll?
b. Can I be on the payroll of two companies(A&B) at the sametime - so that I don't loose an established job, lets say with A, and as well satisfy the requirement of GC with the sponsoring company B?
c. After joining B, how long I've to stay with B? Can I leave B after I485 is filed?

a) Yes joining B means being on their payroll, which means that you have to work for B.

b) Once you get your GC, you can work any number of jobs, but remember you would have filed GC for a full time/part time job @ B - so you should honor that intent.

c) Well, GC's are filed with an intent of permanent job - though there is no set definition for "permanent", usually 6months, or 1 year (conservative) at the particular job is considered to be acceptable to not raise any red flags at the USCIS.
You can use AC21 clause to not to work for B after filing for 140/485, but there are some limitations (like only after 180 days, and the job/company you are transferring to should have simliar job position/responsibilities etc).
