Can I reset the H1 Clock?

Hi everyone!

My sixth year H1 expires on July 23, 2006. I do not have any labor filed/pending. Recently, I changed my employer and transfered my H1 to new Company. The approval notice and I94 came valid until May 14, 2008. Please clarify the following for me.
1. Does anyone keep track of the H1 clock?
2. Can I return to my home country in July 2006 and come back in say, August 2007?
3. Can I extend my H1 in 2008?

INS does keep track of your clock. Not sure why they approved H1 beyond your 6year limit. Please consult a lawyer.
Leaving the country for 1 year automatically resets the clock. You will have to apply for a fresh H1 to come back on H1.

Here is mu situtaion, am I eligible for clock re-set.

My first 6 years H1B period will be expired by end of year. I was out of country for full one year in 2002. I left on 19th July 2002 and my H1 transfer was applied on 25th July (Receipt date) . I re-entered the country after one year with the Transfered H1. Do you think I am eligible for 6 years from the date I re-entered? If not can I claim for the one year. My payroll ran in US.

You stayed one year in the middle of 6th year and extend the same visa.

In this case you are qualify to recapture only one year period. Unless you get your H1 through quota after one year outside US only , qualify you to reset your fresh 6 yr clock.
