Can I renew my H1-B with a pending I-485?

Hi,

Is it legal to renew my H1-B when I have a pending I485 application? I applied for my GC through my husband who is a USC. My first H1-B expires end of September 07. I haven't applied for my EAD as yet. I have 3 more years left on my H1-B and was wondering if I could renew my H1-B for 3 yrs instead of applying for an EAD every year (till my name check comes through). Will my I-485 application be affected if I go back on a H1-B status?

Thanks. I forgot to mention that I have an approved I-130. Would that change anything with regards to getting my H1-B renewed?

Hi:

No. The H1B is a dual intent visa ---- it will make no difference.
