HI -

I am landed immigrant. As I didn't find any job in Canada, still working in USA on H1B. My GC process has just started and I am on 6th year of H1. My canadian PR is going to expire in July this year. As I am still not in a safe position in USA, can I apply for Canadian PR again in August (after the current one is expired.. I mean I will be Out of Canada for last 3 years by August). If so, how does the process go.

Thanks
Sonali

Sonali,

I am in the exact same boat as you are in. I didn't find a job so I came back. Even my PR expires in Jul05 and my GC was filed a few months back.

I am going to take chance and reapply come August. However, I wanted to know if you filed taxes. I did not and I am thinking of doing it before it expires.

Thanks,

I didn't file any taxes. You need to file Canadian taxes only if you meet certain conditions. Few of them are.

1. If you or your family living in Canada
2. If you have a Canadian Drivers license
3. If you have a property in Canada in your or family name.
4. If you have health card of any province in canada.
5. If you have any sort of income in canada (like interest on savings account etc)... and more..

PR's living outside Canada, need not file taxes unless one meets one of the listed conditions. You can read more in their ccra website.

Technically, the answer is yes, you can reapply for PR again if you still meet the condition for application. But you better have a good reason for abandoning the first PR issued. CIC will not be interested in the reason cited in your post. There lies the real problem.

Good Luck.
