Can I qualify for EB2 - please read!

Friends - my position will likely be listed EB2 as "needs Bachelor's + 5 years of experience". This is a Project Leader position with a software group.

At the time I started on this job, I had a Master's degree and 4.5 years of experience. Would I qualify for EB2 for this position?

My HR is telling me that we have to advertise the position as "Master's or Bachelor's + 5 Years" in order for me to qualify for this EB2 position. Is that right?

They also tell me USCIS can audit the case since my role code does not "need" a Master's degree! How can I find that out? (I looked at the website with role codes, but it's difficult to find out the exact or similar match!).

You can advertise, Master with 1 yr or Bachelor with 5 years.

Your HR is correct. The petition depends on the POSITION available and the requirements for it, along with a higher salary that is required. It does not depend simply on your credentials. The company is not required to file a petition on your behalf under EB2 just because you meet the credentials. The only technical EB2 position defined by the DOL is a CIS Manager. All others are qualified as EB3 unless there is a business necessity for them to be an EB2. I'm assuming that is what your HR is talking about. And yes, as guru says, it is a Master's + 1 with the alternative of a Bachelor's + 5.
