Please see the details of my particular case and let me know if CP is still an option, and is it legal?
My I-140 approved for CP on December 2001 at INS-NSC. NVC didn’t receive my petition till 19th April 2002. On April 19th 2002 my employer ask me to go India and work from India office for six months or work for 20 hours a week which is possible on EAD/Green Card. Since 120 days my I-140 is not moving from INS-NSC, I thought I could file I-485 immediately and get EAD in 30-90 days. I requested my employer same thing he agreed and filed for I-485 on April 19th 2002. On April 22nd 2002 NVC received my I-140 form INS-NSC and also NVC created my case. INS-NSC didn’t cash the check as of today (May 7th 2002).
1. Can I continue with CP? If so what will happen to my I-485?
2. Can I put stop payment on INS fee check? If so is there any future problems with INS? Is it advisable?
