can I opt for CP on 7th year H1B

hi,

Recently I got my Labour(it took more than a year) and about to file I-140. I also filed for 7th year H1B ext in April 2003 as I will be completing my 6 year period in June 2003. My question is can I opt for CP in I-140 while on 7th year ext?

While no body prevents you..

from applying for CP, calculate how much time you will need for I140 at your INS center. Once the I 140 is approved and the file is transferred to NVC, you can't renew your H1b for an eighth straight year; so you may have to go to your home country to wait for an appt a little bit early unless you plan this out carefully! On the other hand, if your job is safe for 6 months, you may consider I140/485 and apply for EAD.;)

CP in the last few months of work VISA

Hi all,

I am in a similar boat. I have 7 more months remaining on my work VISA, my I-140 has been approved. Is it worth taking the risk of going for CP?

It seems the Vermont Service center has made a miostake and put my application for AOS (wonder how as the lawyers were just in process of asking my opinion on which way to go). So it's going to take 3 more months to move my AOS application to CP.

I have also posted a similar query in the 'I-140 tracker for CP' thread.

Can L-1 work visas be extended beyond 5 years?

Would appreciate if someone can give me their opinions.

Thanks Rajeev, I would be filing my I-140 at NSC. I have couple of questions.
1)why can't I extend my H1B beyond 7th year. I heard that one can extend it beyond 6 years(7 or 8) in multiples of 1 year till s/he gets the green card as long as the case has been pending.
2)a)How long would it take to get the interview date from the Chennai consulate from the point we file for I-140.
b)And also from the point when application reaches NVC.

H1b renewals...

beyond 7 years are allowed if you are waiting for an INS process for longer than 6 months. So, if you get stuck at I140 or I485, you may apply for extensions. However, CP does not fall under the purview of INS but under the broader purview of Dept of state. So, you may have a problem extending H1bs after I140 if you choose CP. Please browse the forum for current info/consult an attorney.
Use CPtracker.com for current times, but CP appointments generally happen 6-8 months after approval of I140. Good luck.;)
 
CP out of perview of BCIS/INS

In that case, I guess the same should hold true for L-1s. Guess going for EAD and then switching over for CP can be an option.
