Can I go through PERM, and then EB2, if I am a co-founder and own a part of a newly created start-up company? This is supposedly not possible for H-1B. Is PERM any more lenient in this respect, or are the basic rules identical?
You'll need to talk to an attorney about this question. I would "assume" you can't, because one of the questions on the very first page of the form asks if the person for whom the case is being filed has any ownership interests in the company, and you would have to respond 'yes' to that. I also don't think you can work for another company if you are on H-1B for a different company... be very careful and do your research!
