can I go for interim AP?

Hi all,
I had applied for my 140/485/EAD/AP with a ND of 08/20/2003. I got an RFE on 140 on 10/25/2003 and it was received by USCIS on 11/28/2003. The 140 was approved on 12/30/2003. But, I have no word on my EAD/AP. I have to go to India in Feb. Can I apply for IEAD and AP from the local USCIS office or do I have to wait for 60 days from the receipt date of the RFE?

Hi! If my memory serves me right, it is not the receipt date of RFE you have to be concerned about. You count the days from the receipt date of EAD/AP.

I saw somewhere in this forum (sorry, I don't remember precisely where, so you might have to do a search) that some people were turned away when they applied for emergency AP at the local USCIS office.

I hope either ginnu or theRealCanadian see my post to confirm this. If they don't reply back to you, I would post another one specifically for them.

If it's an emergency and you can prove it, there're no time constraints for AP
 
why dont you try to get a medical certificate for someone sick in India. I think I read somewhere that BCIS considers that an emergency situation and approve it. Anyway that may be your best shot as I dont think they would consider anything else an emergency.

Reagrding EMERGENCY TRAVEL WITH AP

Hello, All.
I have a valid visa till dec'04.
I have applied for EAD/AP/I-140,I-765 through California service center.

I have not got any AP/EAD since 9 months.

My attorney says: since we applied for AP, i canot travel wothout approval of myAP.

Pl. let me know if you have any idea/experiences.

You all can go and try the local INS office. Most offices give AP for any genuine reason- a marriage is a genuine reason. You might not get AP the very next day but many local offices send the APs in 2-4 weeks time. For interim EAD 90 days from RD is enough to make a claim.
