Can I file for AP extension before I travel on the current AP (expires 4/2003)

My current AP will be valid until April 2003. I am planning to travel in Dec. using this AP. As it's taking a long time for the AP renewal in TSC, my lawyer said they can file the AP extension before my travel.

Will this cause any problem? The reason I am asking is that somebody posted on this board saying that one has to be present in US while AP is in process. In my case, my current AP is still valid. We're just filing for a renewal.

Yes U can file . In fact U can file as many APs U want. This is one of the reasons why I insist that U need not be here when AP is approved.
 
Jaxen, what about first AP? Is it safe to apply for first AP, travel before it is approved and have it mailed to you abroad to use on return travel to the US?
 
Clarification!

Jaxen, I always like the way you reply and give your advise for those who are in need. I am also in the same boat as Gc_Gz. My question is, what about I-94? If you apply for renewal using the old I-94 and travel, there will be a mismatch on the I-94. Will it be a problem? Will INS reject the application saying the I-94 is different? Continuing on the same subject, Can one apply for EAD renewal and set for Travel? Please share your experience Jaxen. Highly Appreciated!!

There is no I94 matches done by INS while processing AP. However, you are required by INS to be here in US when AP is approved. If there is a RFE, then your plans might go awry.

Jaxen, Does the same analogy of I-94 matches work for EAD as well? Do you think one can expect RFE in one month that too from TSC?
