Can I extend H1B after entering US on Advance Parole

Hi!

I am going to India in April and will be returning in May04. Since my Visa has expired in Jan04, I intend to enter US using my advance Parole.

My H1B is valid till June04 . If my I-140 does not get approved before May 04, I want to extend my H1B after June04. (No, Not seventh years extension. I have still 2 years of Six years of H1B)

Is there any problem?

Your opinion and advice will help me in deciding my travel plan.

If you use your AP doc your current H1 will be voided, You have to get a new H1 not the extension of current one. If you have some one to file new H1, you should be ok. And also current year H1B quota is completed, so probably you might have to wait till oct 2004.

But I read in the some postings in this forum that I can work on H1B even after using my AP to enter USA.

Is it Correct? & The issue you described is valid if I am going for the Extension?
