Can i do CP for wife in pakistan while doing AOS here for me

Hi All,

I am currently in AOS stage. Have my AP. I want to get married back home and I am trying to explore my options of bringing my wife to the US. My I140 has been approved.

Would appreciate it if someone can tell me what kind of process to follow. Is CP the only alternative? Is it also called follow to join?? What if she comes here on a student visa and then files AOS?

If I file for CP how long will it take for the process? will that process depend on my AOS? or will I have to change to CP myself?

Too many questions going thru my head... so I would appreciate it if anyone could explain me this process and its implication on my AOS application here.

Ans: She can come on F-1 student visa and be included on our AOS papers. Preferrably get married and then file for AOS so that she is included on your immigration papers.

Ans: CP and AOS are mutually exclusive. They cannot happen at the same time. You have to chose one or the other. Since your I-140 is approved, CP will take another 6-9 months.

Also try to get in touch with user id 'txcp' and 'zaye' as they are undergoing CP thru islamabad and will give your exact information and share experiences.

Also search for the terms 'pakistan' or 'islamabad' and you will find a lot of information that you can sift thru.

You cannot have AOS ( 485 ) and CP at the same time. If you want to convert CP, then you have to file for I-824 ( I believe, as you are already in 485 ), and that will transfer your application to CP. But these days it is taking some where from 8-10 months for the processing to this application, and then after this CP will take about 6-8 months. If you have just started your 485, then depending on your INS office, you can think about converting to CP. The processing of 485 is varied from office to office. I know TEXAS and currently there is about 26-28 months backlog. I am not sure if Islamabad does AC-140, you may ask them. As far as if you go for CP, then I believe as long as you married before CP, then you can file jointly. BUT do ask a lawyer. The reason for my thinking is, you are the principle applicant and your wife will be given immigration on your petition. But do confirm it from lawyer as well as embassy.

Sure F-1 is a valid option, but then she has to maintain valid F-1 status, till 485 is approved.

I-824 - -> 8 - 10 months.
CP - -> 6 - 8 months.

I completed CP in Islamabad in June'03, and had no problem. But my case was a little different as my wife was already here in US on H-4, and her DS-230 forms etc were submitted along with me to NVC, and when the file reached Islamabad, her name was also in the file etc..
