I posted this question in another forum but noone answered. I hope someone can help me here.

Hello folks,

I need some advice and I hope someone can help me.

Here is my situation -
Oct 2004 - got H1 in
Sept 2005 - scheduled appoinment for visa stamping in Mumbai
Dec 2005 - visa stamping appointment date

Now, last week, I got an offer from a very good company and they want me to start in Dec 1st week.

My worry is that when I scheduled my interview at Consulate I sent the required docs - I797 from my current employer.

Question - can I change jobs before the interview and take new I-797 (assuming that my H1 can be transferred in 20 days)
Also, I will not have any pay stubs from new employer so would that be problem.

Please let me know what you guys think I can/should do?

Thanks much for your time.

Best way is , first get the old company visa stamped, come to US, next day ask new employer to transfer it under premium process.

OTHERWISE YOU HAVE TO HAVE BRAND NEW h1 (NOW QUOTA is OVER FOR YEAR 2006) AND GET IT STAMPED OCT 2006

Yes, I know that is the best way. I was just thinking if there was an alternative to that. As the new company can't wait - I have to refuse to their offer :(

Why do you say that I have to get a new H1?? Do you mean that H1 can not be transferred without being stamped? I already have an h1 approved so I do not fall in the quota till h1 expires, correct?
