can I apply for PP after submission of RFE

my case detilas are below. i applied for EB1OR (concurrent filing) at VSC in sep 2005; and my case has been transferred to NSC in may 2006 (both 140 and 485). i got RFE from NSC in november and replied in the december (general RFE; no specific point). i found LUDs for consecutive dates in late january and early February 2007. my case is not PP

when they got my RFE response; NSC mentioned that i need to wait for 60 days to get a reply. please suggest the fellow db members; whether should i wait or can i go for PP.

one more question i do not know whether i can go for PP or not; as I already submitted my response to RFE.

FP: nov 2005
case transferred to NSC: may 2006 (both 140 and 485)
RFE on I-140: nov 2006
RFE replied: december 10th 2006

FP: feb 2007

I don't know for sure, but I don't see why not. You can try and if it doesn't work they will send the money back.

But if I were you I wouldn't do it. You should have an answer soon. It's been more than 60 days, and at this point I would suggest that you (your lawyer) should initiate an inquiry. Maybe that will speed things up.

I agree with ioananv .. if you want to put $1000 on pp ...file a new I-140 and pp that one ... or just wait.. good luck
