Can I apply for H1 Visa when My Spouse has GC in process

Can I apply for a H1 Visa when my spouse has the green card process in progress. It is still in the initial stage and I am wondering whether I can work on a H1. Will this affect me in getting an EAD card thru my spouse.

Yes you can get H1. No it will not affect EAD.

I know a couple who went thru same last year.
no problems at all.
H1 is a dual intent visa ie., it does allow u to immigrate from the start unlike student visa which doesn't enjoy 'intent to immigrate'. goodluck
