Hi!,

I got my GC in 2007 but I have been going out to my country for my education. I have been out for 11 months twice and 22 months once (reentry permit). I have gone only to complete my bachelors and masters. Now I am here for the last 14 months and working with one of the top 5 IT companies of US. Can I apply for citizenship ? my continuity was broken but I had gone only for my education. I was also reading Act 316 if that can help.

Please advise.

Thanks!

Thanks all for replying.

Are there any exceptions ?

Actually I am getting married at the end of this year in my country. I am on GC and i believe that it would take atleast 3 years before my spouse could get her GC.

Is there any other visa etc. that I can apply for and get my spouse here after marriage ?

Thanks for all your help!!

Well, if you were out for 22 months in one stretch, the only exception is that you can apply for citizenship 4 years + 1 day after your return from the last long trip. The 11 month trips can be construed as not having broken continuous residence since it was just for a study, but this is hit or miss. So, unfortunately, you'll have to wait about 3 years at least. Also, you can't apply 90 days early with the 4yr1day rule.

To get your spouse here without a delay before you get citizenship, she'd need a work or student visa. Can she get a job that would sponsor her, or register at a community college? Otherwise, it'd have to be visits, or she'd have to come and then overstay her visit visa. That'd just be a hassle, though... and not allowed.

Is it possible to get a visiting visa for her for atleast 1 year or more ?

Also can I go and visit my country for 2 months? or that may become an issue ?

With a visa, she can only stay for 6 months at a time. She can apply for an extension, but there's no guarantee it'd be approved. You can go for a couple of months. That's not a problem.
