Can I apply for AP after I work Under the 245(k) rule? Please respond!

:) I have a pending I-485 case. I don't have my H1B1 anymore since I did an AC21 to a new company with no employment gaps. My EAD is expiring on Feb 5/07. If my EAD renewal doesn't get approved until after that date, I will be working under the 245(k) rule. IF I work out of status under 180 days, once my renewed EAD card comes in, can I apply for AP and leave the US to go to Canada? Will this burn me?

That's fine - since working without authorization isn't illegal presence.

Do I need to inform BCIS of my 245(k) status? As soon as my EAD renewal gets aproved, can I apply for AP and go to Canada once it comes in?

These days there's absolutely no guarantee you will be let back in the country even with AP . Do it at your own risk :eek:

Robin :D

You do not need to inform any one. They will take the action on their own. You can apply AP now it self. Once the AP is approved you can go to Canada. No relation to EAD here.
 
I-485

I know one can file WOM if your case is delayed for naturalization, can you do similar if the I-485 is not adjudiccated in time
