Dear friends, I need your expertise.
My situation is this: I hold a Brazilian and Spanish passport and have always been traveling to the U.S on a Spanish passport so no need for a visa. In 2007 I came across the opportunity to have a green card through my stepfather. So, my lawyer said I could stay in the U.S even if my tourist period expired because we would ask for a change of status later on.
A lot happened and after 11 months in the U.S my lawyer told me I had to go back to Brazil and had to wait for my green card here and I could not visit the U.S for 3 years because I had expired my period as a tourist but since it had not completed a full year illegally in the U.S he said that I could voluntarily leave the country and had to stay out for 3 years.
That's what I did, since then my green card application has been approved and I'm on the waiting list since my priority is F2B.
After those 3 years, I tried traveling to the U.S with the Spanish passport and the website says I cant and that I should apply for a Tourist visa, on the Brazilian passport but they don't tell me why so I haven't been to the US since I left, this was 5 years ago.
Since then, my mother and my step dad are thinking about getting a divorce so I would have to withdraw the green card application.
I recently started working for Oracle in Brazil and the company requires me to have a Business visa to travel to the U.S.
My question is: In the current situation, can I apply for a business visa having a letter of my company as proof of necessity? Or is my green card application going to be a problem?
