Can I Adjust My Status Without A Valid Passport??

Dear all, your knowledge is much appreciated regarding the following matter.

I entered the US with a student visa (F-1) and I am about to marry my girlfriend (a citizen). Due to the rules of my home country, I might not be able to renew my passport when it expires this November. My question is: can I adjust my status without a valid passport?

Specifically, will the immigration official refuse to stamp the passport if it is expired? And assuming that the official refuses to stamp the expired passport, is that a problem (since an actual green card will be issued later anyway)? I was told that an expired passport is not a problem as long as I have my I-94, but I want to confirm this matter.

Finally, besides the initial stamping, are there any future occasions when I will be required to produce a valid passport (for example, during the removal-of-condition interview, or naturalization)?

Since they don't seem to be stamping passports anymore (I got my actual green card within a week of approval), you shouldn't have a problem in receiving your GC. However, they do require copies of several passport pages for filing I-485, so I'd think your passport needs to be still valid at that time.

As for future occasions you'd need a valid passport for - international traveling would be one.
 
U don't need to have a valid pp , don't worry about it , all what you need is a pp that's all . even if u need to leave the country u can , but i wouldn't leave without GC . best luck for all of us .

Are you telling us that one can travel outside US without a valid PP and even return? I'm very surprised that this is so. Can sb confirm this?

Thanks for the quick response. I do not intend to leave the US until I become a citizen so having a passport for travelling purpose is not a concern to me. And I do have a valid driver's license so I will be able to enter a federal building with it.

So you are saying that I do not need a valid passport for adjustment of status or any other immigration purposes? Could you elaborate on it a bit more? Thank you so much! :)
 
Once everyone gives you their 2 cents, this is the kind of question I would run by a lawyer twice rather than once before filing...

Good call buckdany! :) The problem is, that's exactly what I have done. I have asked 4 immigration attorneys (one of them being a certified immigration specialist) about this but they all have different answers. Two say you need a valid passport. One says you technically don't need a valid passport but it's better to have one. Yet another say that you don't need a valid passport at all.

Is there anybody out there who was actually in the same situation? Again, the question is, do you need a valid passport at a marriage-based adjustment interview or do you just need "a" passport (an expired one)? What about at the removal-of-condition interview 2 years later? And what about for naturalization?

i am saying that you don't need a vaild pp for immigration , or what u need is just a pp if it is expierd that's ok ,

when i said you can travel i meant you can travel out of USA to your country with expierd pp and when you are there renew it , they allow you to go back to your country to renew your pp . BUT i didn't mean you can travel always with expierd PP , i just meant to your country to renew it .

And one more thing , you can always send it to your country embassy and renew it .
