Can i-30 be withdrawn after its been approved

Hi,
My wife and i did went for out interview(01/11/2010) which happened to be the last stage for my adjustment if status and to God be the glory it was approved. But to my surprise she has been giving me issues since we left the interview room which i don't know why. She threatens to withdraw by sending them a letter that she doesnt want to continue. All i will like to know if can she still stop it after my green card is been approved.
I have tried all my best to calm her down.
Please do advice.
 
I don't know if you can withdraw a I-130 after the approval the I-485. However, if your approval was based off a marriage that was less then 2 years, then you will have to file an I-751 with your spouse in 2 years minus 90 days in order to remove your conditional status.

No she cannot withdraw it after it's been approved (but maybe you shouldn't tell her that, because knowing that may make her rush to withdraw it before the GC is approved).

However, if you have been married for less than 2 years, her input will be required 2 years later when the conditional green card is expiring, and her lack of cooperation at that stage could create big problems for you.
 
So let me get this straight, everything was hunky dory before the AOS interview and in the last 48 hours, she has started giving you issues?

@DHLUNAR: Thanks for the reply. we have not been married for up to 2years. The GC was approved on monday 11th of this month and its been hell after that though it had always been like that ever since.

@JAKOLANTAN: We have only been married for 8month and the guy that interviewed me said i will be issued the two years green card and i need to file some sort of form 90days before the card expires. The I-45 as been approve and i got an update on my status in the mail stating that the notice and welcome letter is been sent. I don't think the green card is been produced. I saw her print out the form yesterday stating that she doesnt want to be responsible for the I-30 petition again. Will this stop the card production.

@TRIPPLE CITIZEN: It has always been hell since we got married, alot of threat and abuse, she even threatened me to sign a divorce form, i have been slapped and abuse emotionally. I do really love her i guess that was what kept it going. Moreso pressure from her family is also the cause of the problem. to my surprise a week to the interview she change telling me she is sorry and will love to make all work out, we did went for the interviewed and it was approved on the 11th of this month which happens to be this past monday after which she said again she is going to write them that she doesnt want to be responsible for me again. Note she has ones mailed immigration even before i for my EAD that she wants to withdraw but fortunately she mailed them back again that they should continue but to my surprise they did continue and the reason which she was told on the interview was that his supervisor told him to continue, if not it would have been withdrawn with the first letter she sent november last year.


PLEASE ALL WHAT SHOULD I DO OR WHAT CAN I DO.

It's I-485 and I-130, not I-45 and I-30.

The status indicates your green card has already been approved (even if it's not physically printed yet) so your wife cannot do anything to stop or revoke it. Now she is financially responsible for keeping you above the poverty line and off the welfare rolls, whether she likes it or not, and whether you stay married or not. But you still have to worry about the I-751 when your card is about to expire almost 2 years from now.
 
Hello Jackolantern, Thanks so much for the answer. So if she calls them or mail them it has no effect on me. I can try to get a job and not worry her about that, i do love her and will never hurt her in anyway. Yes i do worry about the I-751...
How do i go about that in 2yrs.
She wants me out of her house but i haven't received my GC yet. How do i go about that???

Just work out and bang her every night for the next 21 months...:eek: Just work out your marriage dude, wives can be difficult especially since she realize that she has control over you, immigration wise. :mad: The facts which are irrefutable are these: once your GC is approved, she can run naked to the USCIS office and seek to withdraw her support, it won't happen and she will be arrested for indecent exposure. Moreover, she attested to USCIS officials that this marriage was in good faith, so how all of sudden when the GC is approved she's now mad and doesn't want to be responsible for you. :cool: Any form which she prints relating to immigration shouldn't make you uneasy.

There is no supervisor who told her to continue with the immigration process, she never mailed the letter in the first place. She is just screwing with your head. What we are telling you, just keep it to yourself and act stupid, otherwise she might decide to do more harm than good to you.;) It will look really bad if she files for divorce now as opposed to a divorce 22 months from now, which I believe with reasonable evidence you can overcame and get a 10 year GC. So, be on your best behavior, and don't allow her to beat you up or even slap you, document this or call the cops. If the relationship is abusive, then you can make a convincing case to USCIS in 21 months. However, allow her to spank you only in bed...:p

Thanks so much for the comment. yeah i did document the physical abuse at the hospital but didn't press any case. I do work out and i do try my best satisfying her sexually and it amazes me that is the only time she says she loves me and she will never leave me aside that she hate me. She is really screwing with my head.
She did sent the first letter and she replied them to continue, i knew when she sent back the second letter to cancel the first letter. she even went as far as closing our bank account and ended the lease of where we live without me knowing.
I really do love this babe and there it will be my pleasure to stay with her not for the 10yr GC, thats only if she behaves like a sane wife.
I am really tired and fed up.
I will definitely try my best.

@indian citizen....lol... i am not married to a wrestler..... is slapping ur spouse not a physical abuse....

on the risk of invading your privacy: your wife has likely serious mental health issues and needs professional medical help. If you haven't done so already, I'd advice you to first find a good local counselor/psychologist for yourself and then discuss with that counselor how to approach psychological diagnosis & therapy for your wife. Independent of what the future of your marriage holds, you owe it to yourself and your wife to face and try to solve your problems. Plus, you should be doubly vested as it also helps you settle your future LPR status.

To some of the posters on this thread: your snide remarks with regard rijerita's manhood or physical features of his wife are uncalled for. This forum is all about giving advice to questions, not to comment on personal life style choices or misfortunes. rijerita is already a victim of his wife's mental illness and needs your support, not ridicule.
 
@DavidSEA, I have suggested that to here at several occasions but she never yield to my advice. She tend to believe more in what she is been told by her friends or an outsider and latter apologize if what they told her is just exactly what i said.
Its really not been easy and her family isn't helping the matter at all.

Well, you are in very good position on your immigration aspect. Try to stay married as long as possible. And same time collect all evidences of life together, any reports of physical mental abuse and reports of treatment of any of her mental problems. Keep them in safe place. They will very useful when you applying I 751 by yourself.

One more advice- don’t even slap her back. OK?

@VisaNutz.... she seem really interested in checking the mail box now. She even said 'i will intercept it'..... she wasn't happy when i got the EAD, i don't know why???
How long does it take to get the GC after interview so i can be on the look out...Just had the interview on Monday 11th of jan 2010. Also what happens if she gets it before i do, which i pray will never happen that way.
