Can i-140 be revoked after Approval

Hello All,

Pls Help me .


My 485 is pending for more than 180 days(Recipt Date July 2004).
My I-140 is approved. Since 485 is pending for morethan 180 Days and I-140 is approved, Can I use AC21 ?

1 . My Employer is thretening me "They will Revoke Approved my I-140"
Qns. Is it possible to revoke an approved i-140 ?

2. Am I eligible for AC21 Portability ?

3. Has anybody done this before ?

4. How is the Legal fees/Attorney fees.

5. What are the risk factors in using AC21 ?

6. Do we have to Inform INS with New Employer .

7. Any reference of good Attorneys appreciated

Please Help Me.

My Employer is really Killing my GC and Peace of my mind.

all of your questions have been answered several times lately and recently.

------ employer CAN send the letter to revoke I-140 any time but if you use AC21 and inform USCIS then USCIS will not revoke the I-140 as your I-140 is approved AND I-485 is pending more then 180 days.

---- He cant kill your GC if you find new employer and if new employer is redy to give you future Permanent job offer in same/similar job duties and you invoke AC21
**regarding peace of mind start meditation or learn to relax and GC or US Citizenship dont give Guarantee for PEACE of mind

Does it matter if the role differs. Most of the consulting companies file the GC under title "Programmer/Analyst" (computers/software related applications). What are the titles that closely match to this title ? Please advise.

----You need to send a letter CIS.

---- No, you will in AOS status. You can use EAD for employment.

----Same as above

----Depends. If the gap is small between employment, then immidiately after joining the new company.

6. What are the possible RFEs raised by INS for I-485.
---- Not sure... Employment Verification Letter, Tax returns.... and also possibly ability to pay... But do not worry about this.. You may not get any. if you have to use Ac-21 just use it.. It is perfectly valid to do so and many many people have done this.
