Can husband and wife file two 485 concurrently and include each other as dependent

My lawyer said I can. So far through my application, wife as dependent, we have received AP, EAD, and FP. My wife\'s application, mine as dependent, was two months later than mine and we haven\'t got receipt yet. Should we withdraw my wife\'s application?

It is in her best interest to withdraw her application, else you will receive different A# numbers and finally the 485 approval will take extra time as INS will later try to resolve this reduandacy.

I don\'t think it should slow process down. One of my co-worker did just that. His ND was Oct-00 and he got his approval in Feb-01 (3 1/2 months). I think his wife filed in November which he had to withdraw. Funny thing is that I filed in Sep-00 and got approval in Apr-01 (took me 2 more months then him). Talk to your lawyer. But with INS any thing is possible....

I am supprised that your lawyer says you and your wife can each
file AOS and include each other as dependent. While there are
no laws prohibiting this, concurrent filing from husband and
wife is strongly discouraged. You should withdraw one of the
two and stick to the one you choose.
