Hi,

I have 3 questions

1) Can an LLC owned by a H1B holder operate from other country. I have open an LLC and is a registered agent for my LLC to receive the letters and acknoledgements. The work of the LLC is totaly internet operated and thus can be operated from anywhere in the world. Can this LLC be operated from outside USA, without having any employee(other than me , who is a director of the company) in the USA?

2) I know that I can only do a volunteer work for my company like just responding to the telephone calls and direct the work to my company's branch in the other country, can My company bear the expenses of the company like Telephone, fax, printer, Internet, car etc.. from the company's profit.

3) Is it necessary to have a Green Card/US Citizen as an employee (CEO, Manager) to operate daily activities of the company in USA. (Even when it can be easily operated from anywhere using the internet and doesn't necessarily require a physical individual in USA to operate). In other words, Can an H1B owned company be operated from outside of US, without having any employee in the USA and doesn't violate the owners H1B status.

But you must declare your LLC as a International comapny while forming the LLC and getting your Tax id from IRS. Otherwise the operation of your LLC is illegal
2) I know that I can only do a volunteer work for my company like just responding to the telephone calls and direct the work to my company's branch in the other country, can My company bear the expenses of the company like Telephone, fax, printer, Internet, car etc.. from the company's profit. YES, LLC can run without a employee on pay roll.
3) Is it necessary to have a Green Card/US Citizen as an employee (CEO, Manager) to operate daily activities of the company in USA. No, not at all. (Even when it can be easily operated from anywhere using the internet and doesn't necessarily require a physical individual in USA to operate). In other words, Can an H1B owned company be operated from outside of US, without having any employee in the USA and doesn't violate the owners H1B status. H1 can own any number of LLC or Corporation. Only thing he should not work for the company or take any pay check from the comapny. Ofcourse can take all the profits.

Incorrect. No work is allowed without authorization even without pay for any for-profit organization. Please check with attorney.

3) Is it necessary to have a Green Card/US Citizen as an employee (CEO, Manager) to operate daily activities of the company in USA.

To operate daily activities, one must be authorized to work.

(Even when it can be easily operated from anywhere using the internet and doesn't necessarily require a physical individual in USA to operate)
. In other words, Can an H1B owned company be operated from outside of US, without having any employee in the USA and doesn't violate the owners H1B status.

Check details with your attorney/lawyer.
