Hi all, I got my H1 sponsored from company A, I am still not sure if I got through the lottery. Now I have an offer from company B and want to join them. In case I get my H1 would it then be possible to get my H1 transfered in company B's name before october? if yes then, what are the documents that I would need...thanks in advance for your help

B can file for a new H1 and you will not be subject to the quota (again), assuming your first H1 gets approved.

hi nscagony...many thanks for your reply..so in case B files for my new H1B would I need any documents from employer A like pay stubs and I-797? my employer A is an IT consultant whom I have already paid a lot of money for H1 sponsorship and stuff...in case I would need to get some documents they would kind of exploit me and ask for more money before they give me documents like I-797 etc....

thanks again

You need to understand the difference between a transfer and a new petition that is not under cap. Do some homework and come back if it doesn't make sense.

Hi concerned4us....thanks for your message...I have been kind of looking for information but again its not very clear....can you please throw some more light...I would really appreciate that.

I had another query....employer A as I told is an IT consulting company...they prepared my resume and showed some experience in IT...now employer B is the employer in my own field "BIOLOGY" so when I apply through B as new application with new resume does it kind of lessen my chances to get my visa approved again....
any help is greatly appreciate....i'm in a desperate situation coz employer A is kind of exploiting me....:(

As long as your first H-1B gets approvd you can file for a "transfer" anytime you wnat. You are not subject to the cap.
Also each H-1B application is judged in its own merit.
You would probably have to prove that you are workingfor the employer who filed your H-1,
