Can H1 remain valid even after leaving the company?

One of my colleague (home country India) was working in U.S from Sep 2005 to Feb 2007. His H1 visa got expired in between, then after filing Visa extension it has now got extended till Jun 2009.

Now he is in India going for higher stdies for one year. Thus, will not be working for this 1 year (till Apr 2008).

I want to know if he can use his H1 petition (which is valid till 2009) after his studies are over in April 2008?

Can he get a date for stamping and get his H1 stamped (since he already has the petition) and use it in 2008 after completing studies?

Before going for study get the visa stamping in India for the extended H1. After study using the visa stamp he can enter US with a letter from sponser that his job is still avialable with them (as proof of employment)
