ASYLUM! Can F-1Student apply for Asylum? I am holding F-1, and have been US for 3 months, I am a Catholic and gay from China.

I have legal status which is F-1-student.
I have I-20 from school which support me stay here for 2 years for studying.
I have been US for 3 months.
I am a Catholic.
I am a homosexuality.
I come from China mainland.
I am studying Theology in US in Church University.

I want to apply for Asylum, because I am fearing the persecution and dangers will happen on me when I back to China as I am a Catholic and Gay who studied Theology in US.

Can I apply for Asylum? Any possibility to receive Grant?
If my application has been denied, will cause any negative impact to my F1- student status?
Thank you!

Yes, of course you can. Where are you? You should find someone to represent you. There are some Christian (and other) organizations that can provide representation for free. You have a 1 year deadline to apply, calculated from your last entry into the US.

No, you will just go back to F-1, unless your F-1 will be finished by the time you get a decision. In that case, you will be placed in removal proceedings in front of a judge.

Hi John,

I don't know for Boston, but I remember when I was looking I found some info on the USCIS website somehow that listed organizations that help asylum cases for free. I am in NY so the references I found probably wont help you. But go on the USCIS website - I am sure they have some for boston too! Also see if there is HIAS in your area - they also represent you for free from start to finish. Good luck.
