I am wondering to know if somebody works in the US on H1b and visited other country 3 months back on vacation and had an accident. I have not recovered am now going back to US for new surgeries. Since I cannot walk my brother will accompany me to the US to take care of me and will have to stay about 2 months.
My brother has a B1/B2 visa sponsored from his employer in India. Visa is stamped but he has never gone to the US.
1) Can he use that visa to accompany me? Note this will not be a business visit (original intent of visa sponsor) but a personal visit.
2) Can he tell the immigration officers that he is going to US to take care of me or is it better if he claims a tourist visit? I heard that B1/B2 visas may not be used by family members for nursing or medication and should only be used for tourism…but am not sure.
