Hi all,

Call anyone share how RFE for National Interest Waiver applicant look like...since no labor/prevailing wage required, will the RFE be very simple to just need EVL?

Those EB2 NIW cases, please share!

alligator2, did they ask for pay stubs, employer's ability to pay, W2 and stuff like that? They shouldn't because we are NIW!

Clarification

I have filed my I-485 on a NIW. I am currently using my H1-B visa. My visa expires in some time now. What I wanted to know is, do I need to have a job after my H1- B visa expires or bcoz I have a valid EAD I need not be employed. I plan to take a break for a couple of months as I have my exams coming up and then take up a job. Is it ok or bcoz an I -485 is employment based would I be out of status?

u will never be out of status till ur 485 is pending u should not worry about that

I had to complete 3 years in an underserved area. I complted in 1/2001 and filed right away. I guess I was unlucky.Anyway its over.

RFE for NIW

Hi ted,

We recently recieved RFE and it included all these, letter from employer statig permenant employment, as a fulltime emloyee, W2, paystubs, salary details and so on. So that is there. Now we are wondering how we are going to generate this letter of permenant employment, as it is not.

So there we are, Perplexed!
