Hi Guys,
I am in a different situation,I cleared my I140 in dec\'2001.Bcause I was on bench my company has send me to UK on workpermit.Now am in UK with workpermit validity of 5 years.
But I would like to go for CP ,I want to take American embassy in LONDON for GC interview.Being an Indian am I eligible to do so or not?
2.Without an address in USA can I apply for CP?With whom INS will communicate,with my Attorney?Without physically staying in USA am I eligible to go for CP application.My family is right now in INDIA and will be soon joining me in UK.
3.My H1B is valid till April 2003.
4.How long it is taking to clear CP application in TSC?.
Thanks in advance.

So, actually CP is for people who are not resident in the US. For people in the US you have Adjustment of Status (AOS), but we go for CP to circumvent the AOS delays.

You should be able to continue your CP application where ever you may be. As for getting an interview in London that I\'m not sure, because normally the interview is conducted at the post that has jurisdiction to the area where your passport was issued, e.g. if ppt. was issued at Ahmedabad, then the Mumbai consulate has jurisdiction.

Having said that, some US consulates agree to process CP applications of residents who are foreign to that country. For example, I\'m not sure if this is still the case but the US post in Mexico used to process CP\'s for nationals not from necessarily from Mexico. So you have to find out if the London US Consulate/Embassy does this or not. Also after Sept. 11, I\'m not sure if they even entertain this.

Hope this helps. Your best bet is to get your lawyer to clarify this for you.

1. I\'m assuming your I140 was cleared for AOS. What you need to do is file for an I-824 at TSC (since thats where you got your 140 from) and designate that you will do CP.

Since you are presently in the UK you should be able to process in London. There should not be any problem regarding this.

2. Sure you can. CP is meant for people who are not in the US. The NVC will communicate with the attorney on record.

4.I dont have a clue on how long it takes TSC to process an I-824. One approved you should be interviewed in about 4-6 months.
