Can an O1 visa holder form a corporation?

I am an artist with O1 visa, who will be working on a series of projects in which I need to hire subcontractors & require liability protection. I am wondering if as an O1 visa holder I am allowed to form a corporation (LLC), or if I have to let my sponsoring company hire my subcontractors?

Thank you

Yoko

hi,I am an artisit , i was an O-1 visa holder for 5 years and I opened a corporation.
BY LAW you CAN NOT open a LLC, but you can open and INC.

I dunno if you know the difference but yeah, as a non-immigrant worker, your only allowed to open an corporation.

Technically you may incorporate a company while on a nonimmigrant visa. But the USCIS will not look at it favorably. If you are the sole shareholder it will be construed as working without authorization even if it is an Inc. So differences between a LLC and Inc. does not matter.

thanks

for the replies...

Recently I also learned that yes technically I can form a corporation but I cannot work for it - (requires another authorization & O1 application)

thanks again

0-1 requirement

hi,

ive read somewhere that student awards dont carry any weight for approving the o-1 visa, would that even include student category in the academy awards or emmy award or the likes ?

No, that wouldn't be included, but you'd have to WIN one of those awards to demonstrate excellence. Nominations are not normally enough.
