Can Amend I-140 pending with new Labor Certification ?


I have filed LC with my company in Dec 2001. I have filed I-140 in Oct 2002 with LC substitution with an LC approved for someone else. If LC filed in Dec 2001 gets approved can I amend I-140 pending with LC approved for me ?

Can we amend I-140 pending to make it CP ?


Please share your thoughts ?
 
I think that I-140 application is tied to a LC. If you have already filed for I-140 using Labor Substitution, I think you cannot substitute with the new LC and continue with old I-140.

I'm not a lawyer, I have only heard about this from some of my other friends who are not lawyers either.

If you find that it is possible to use new LC with old I-140, I will appreciate if you could share your info in this tread.

My I-140 application was filed in March 2002 using Labor Substitution and have still not received any approval / denial / RFE. I'm not sure if using Labor Substitution is causing the delay in my application :(
