Can a person return from canada with an expired stamp in passport?

Hi Guys:

I am on a H-1 and my wife is on H-4 visas. Both of our visas in the passports expired in Oct 2001. We have applied for our extensions and we got them approved. We also got new I-94s which are valid until Oct 2004.

If we go to canda for a visit, can we return to USA with the above documents? Is there any significance to the visa stamp in the passports?

Yes. You are supposed to havet a revalidation stamp when you come through the POE from Canada. However, there is also a provision of a 30day no visa stamp required territory law for travel in and out of canada and mexico. So you should be fine. Surrender the I94 while going out. Get a new I94 while coming in. Show your old stamps and I797s to the officer at POE. Tel them that you are planning to apply for revalidation with state Deptt. (St. Louis)
 
Please check with your lawyer before going to canada believing this forum. While

I was crossing the border to USA after 9/11, I asked the border
INS officers about this 30 day rule and they told me that they
have temporarily suspended it. I do not know what is the status
now. Please do not believe the forum blindly ...just my thought !!

Thanks guys. I found this piece of info on the U.S. Department of State website. The info on the website has been upated after September 11th.

"Would-be applicants who do not need a visa to remain in the United States may find it more convenient to apply for a visa elsewhere in conjunction with their next foreign travel. Those who plan to visit Canada, Mexico or, in the cases of students and exchange visitors, adjacent islands, may re-enter the U.S. within thirty days on expired visas as long as they possess a valid I-94 form."

I have taken appointments for me (H-1 Revalidation) and my wife (H4-F1) for Jan 10th. We got our visitors visas to Canada and we are going to Montreal. If we do not get our visas we will come back using that 30 day rule.

Any Montreal experiences, please post.....
 
Do they give the Visa on same day??

In Montreal, do they give the visas on the same day of interview? Please post if you know?
