Called USCIS using TIP here...Don't know what to believe

I called USCIS using the TIP in this forum, I got a lady who asked for my A# (I was expecting that she would ask my EAC receipt#) and as soon as I gave it to her, my call got cut off and after trying 2 times immediately I was able to connect again and the lady again asked for my A# and I gave it again, then she asked me whether did I call sometime back, I said Yes, she smiled and said that when I gave her my A# first time i called, she opened my file and was reading it before the call got disconnected, then when i called again and gave her my A# again, she was surprised to hear the same A#, so that's why she askedme whether I called before.
She said that my case is on track and everything is OK. When I asked her about my name check, she said that it was done recently, then I asked her whether it was on 21 and 22 Dec, she said Yes (My LUD changed on 21 and 22 Dec). I am confused whether she misinterpreted the FP with the name check as my FP was also done on 18 Nov and results received on 30 Nov.

I asked her whether my case was with adjudicator, she said Yes, and said she didn't know the time frame for my case to be adjudicated. I also asked her whether there was any RFE, she said NO and I also asked her whether I come under the retrogression, she didn't seem to understand and i explained again, saying that my priority date is 11 may 1998, then she said retrogression will not affect me and she also said that she cannot find priority date.

I don't know what to believe.
I e-mailed FBI twice (25 Oct and 8 Nov) regarding my name check, but still didn't hear from them anything yet.
Waiting for the FBI e-mail to verify this.

You will most likely hear from FBI by the end of this month. I believe they are now responding to mid-oct email requests.
 
I talked to my friend and he told me that FBI has replied to his email dated Oct 13th, so anybody close to mid Oct should be receiving the emails from FBI.

And regarding your main concern, I too called VSC and when I asked the rep about my FBI Security clerance, she told me that everything is good to go and my file is with the adjudicator and I should be fine and when I specifically asked her about my FBI Name Check, she said that it was done on August 04 and everything is fine, but on the next day, I received a letter from USCIS that my application is pending because of FBI Name Check pending. So bottom line is that the rep saw your Finger Printing results and I am 100% sure that some rep are still getting confused by all the security checks and they are thinking that FBI Finger Printing is same as FBI Name Check. when did u call USCIS?

what i think is they must have sent you a normal letter saying Name check pending

The thing is when i called USCIS, when the lady said that the name check was completed recently, then I asked her whether it was on 21 and 22 Dec and she said yes because these were the dates where my LUD changed without any message change whereas my FP was done on 18 Nov and USCIS received my FP results on 29 Nov which reflected in my LUD change and message change on 30 Nov

And alsothe person I talked to is not the usual 800 number cust rep but she was a person from Vermont service center so she might know the diff between FP and Name check.

So my point is that till you get a written conformation from FBI that your name check is cleared, you cannot be 100% sure that it really is cleared.

When I called the VSC (Not NCSC) and I talked to a knowledgable rep and she told me that all check are done, but within two days, I got a letter from my congressman saying that my name check is pending with FBI.

I agree with u that till we get written notice we cannot say anything

But the thing is:

The congressman's office might have just mailed a notice so that u will not pester them for a while....who knows that they r true?

Also ur ND is from 2002 and as I have seen from this forum that many people's name check was delayed for 2002 and early 2003 cases but mine is Feb 2004 case, and people in 2004 are in a much better shape then people from 2002 and early 2003

Also what can we account for the LUD changes on 21 and 22 Dec in my case when already my FP results LUD changed on 30 Nov?

The time frame between 18 Nov (FP date) and 21 Dec (LUD change) is almost 1 month and I have heard that FBI also sometimes completes name check in 30-60 days after FP

Also u know what, there is a case (EAC0304952506) which was filed on the same day when I filed only my I-140. The day was 4 Dec 2002 which is near ur case. I have been following this case from then and on 25 March 2004, I saw the message change to FP results were collected and pending review and to my horror on 7 January 2005, I realized that his case was transferred to NY that is after 2 years 1 month. This is one of the example why 2002 cases were slow. ( i consider myself lucky as my employer did not allow for concurrent filing but allowed only I-140 otherwise i wud have stuck like u guys without any clue), so this might be one of the reasons ur name check might have been stuck in the general flow of applications filed during that time


So based on these, I am hopeful that my FBI name check might have been completed, may be

This is confusing now!!!!!!!!

I too called up Vermont Service center sometime end of last month !!!! I was told specifically that name checks were completed !!!! I did not ask for dates . Now upon reading your posts it looks like Vermont folks are taking us for a ride !!!!! They dont seem to be knowing what they are talking !!!!
Also, Emails to FBI do not seem to be getting any response !!!!

I have a question...!!! by the end of this month I will complete 540 days processing time. Does that qualify me to call up congressman to do an inquiry

Also ..typically how long does INS take to update their database(LUD changes) from the time finger print results are sent to them !!!

Please advise

for the various posts I conclude..

1. FBI would respond if name check is never requested from USCIS ( or is done / complete )

2. If name check is pending with FBI they are not going to respond

they will respond only when pending name check ( at FBI ) is complete..

FP name check is entirely different from FBI name check..and FP name check takes few hours ( upto 45 days ) ( FBI name check / background check can take years )..

I called again today in the morning but that lady refused to give any info and said I have to call USCIS 800 number.

I tried again now and this time the lady took my A# and I asked her specifically that whether my name checks were completed 4 to 5 times and she said yes and I even asked her that these are diff from FP check and she said she knows and told me all the 4 times that my name check has been completed and told to be patient because it may take 30-60 days after name check to get adjudicated it seems.

btw they also have a record of how many times I called and she told me not to call again but to call 800 number

So I might be sure that my name checks are completed
 
Called using the tip - Security check not done!!

I had called using the tip and was able to get connected to Vermont Service Center. (I had to use my wife's case number - My case number always seems to have a problem). I talked to a very nice polite gentleman. He says my case was sent for security name check to FBI on August 2004. I had filed my case in March 2003. I don't know why it had taken them that long to send for name check.

I had also sent an email to FBI on 10/20/2004 asking for name check status. I have still not received a reply from them.
 
Be Careful while calling USCIS

Guys,
I would like to warn my fellow forum friends that be very carefully while calling the Vermont Service Center using the Tip. That number is for cases who have some serious problems with the cases and for people who received RFE's and not sure what it is.

I know for a fact that if you have filled your applications and your ND is not current as per the USCIS processing time frame, then you will have real problems if you are using the tip and calling just to find out the Name Check Status as they maintain you record and the rep can log your conversation and they can potentially delay your cases for no reason.

So my suggestion is to wait for the FBI Name check email and if your date has past the official processing date, then contact the congressman or senator and once you get a reason for the delay and if you know that your delay is due to name check then you can call them and you will have a valid reason to fight.

It looks like that since I have called earlier couple of times to NCSC about irregular dates of mine and my spouse, recently when I called VSC, the rep acutally warned me not to call them for the same reason again. My 2 Cents!

Please use your judgement and act accordingly!
 
Is this FBI name check is mandatory for each and every case like Finger printing.

It seems like FBI name check is a length process, Can we initiate our own FBI name check with FBI much before, that way FBI will have my record in their database much before USCIS initiate that process.

Does it make sence ? :) :)
 
Same here

Thanks to tips provided by tellmewhy and cbeking, I was able to speak to someone in VSC today (last week I spoke to some one in National SC and did not get much info). She said my case is on track and sees no issues (did not confirm name check though) but I still have to wait for the adjudication. My FP was done on 10/5/04 and the FP status does not show and the LUD changed only once on 11/18/03.

What she is telling you is accurate. Basically my case was approved and they had not updated status online. I called them and they told me it was approved and I did not believe them, but I did receive an approval email after 2 days.
 
What does it mean

I talked to Nice lady who collected all information. Since my LUD changed for 485 on 12/14/04.. I asked her for the reason..and got a reply that Interagency report received. Not sure what that is.. I wish its my name check...any idea ?

I know this was an old post but I just happaned to see it recently and I cannot help but asking the following question to needhelp1 .

I notice that you keep saying this "the rep can log your conversation and they can potentially delay your cases for no reason" thing again and again , did you have any prove to make you said so ? Did the rep in VSC tell you so ? It's very hard to believe people will get penalty just because they made a call thru their "service" line.

If you don't have a solid evidence , please do not create this kind of rumor, it doesn't help people at all. But if there is something strongly make you believe so, my apology and thank you for your advise.
