Called IIO yesterday about when to file for EAD Extension and to check the status of my case (RD 09/22/2002). The IIO was a nice old lady, she informed me that my case is with the officer, but she didn't give me any time frame as when should i hear something from them. As far as EAD extension( which is expiring on 01/24/2003) is concerned she said it is advisable to file in mid november if i don't hear something from them by that time. She also confirmed that things will slow down in December as lot of people are taking off during that time.

My question is :
1> I am leaving for india on 9th, so if i get a RFE or approval after i leave. What are my options for travelling back to the US?
2> How long does it take for an officer to make a decision once the file reaches him?
3> What are my options if my case gets approved on the day before i leave i.e on 8th? Can i still use my AP to travel?

please understand that if your application doesnt get approved by 1/23 and your EAD renewal doesnt either, you cannot work.

Hopefully you will be approved by then. But my advice is to file the EAD as soon as possible. You might waste $120 but it still might be a wise decision.
 
Well i need to renew EAD for my wife. I am still working on my H1. The company got my H1B and my wife's H4 extended as well. But my wife started working using her EAD so i belive she is not on H4 status anymore.

these days INS is processing EAD's right off the bat. For most EAD cases it is taking them 3-4 weeks to approve. Specially with extension, there is usually minimal chances for error or complication.

If your EAD is expiring on 1/24, normally you can wait till 12/4 to be safe. This means giving them about 7 weeks. But if you take holiday time laziness of these already clumsy dumbass bums into account, you might want to send renewal application by mid november.

If your case is approved while you are gone then you can stamp anytime , as far as I know.

Also keep in mind that It is mentioned in AP that if 485 denied then it may not be possible to enter and I guess you can appeal from outside US.
