Called emergency number

Hi,
I am bit frustrated after calling 1-800 number and then emergency number.
I wanted to enquire about my I-485 case.
1-800 number person says that my personal records are not with her.
Emergency number person says that my case is pending.
I asked specifically whether it is name check or something else. She says that status says "pending". Nothing else......
Anyone else also got the same response?
 
Try again. I got bad response first 2 times.

By third time, I got more educated and lucky. The person initially refused but later spent almost 10 minutes on phone with me and checked my case in details.

I got some new theory. Name check happens in Quota and it would take some time before your name check may come thru as FBI has sent the name checks in for previous quota, not for one in which my name check request was included.

Also, he told me my case looks all fine, no issue or adverse remarks. He had all the details of my address, attorney who filed, EB category, my previous experience details etc.

First thing, I have no clue how this quota stuff works. However, going by what I was told, I am sure you must be in the earlier quota.

Well, I also received RFE on I-485 regarding my birth certificate.
And I responded to it on first week of January.
Don't know if that triggered another name check?
 
I hope name check is done once. How many marathons does USCIS need to run to approve a case?

By the way, is your 140 already approved?

CSC emergency number: 949-389-3007
I am not sure what a emergency is for CSC but you can try to call for your case ...

Yes, my I-140 is already approved.
I read in the forum where people have found that name check was done twice by FBI. So thought that even I am one of those unfortunate ones

How do you know that your name check was done twice?
Did you check with FBI?
 
No it wasn't done twice. Everytime they take ur FP, they send a request to the FBI, and the FP results are done (even if they were done before). Namechecks are only done once from what I understood. I bet those people claiming the name checks were done twice are confusing the FP check with name check. Just my 2c.

Assuming name check quota concept is right and looking at my March'04 RD for I-485, I guess my name check should have been done.
I did call emergency number last week and they told that it is "pending".
They did not tell whether it is "name check" or "additional security checks" pending. My file just says "pending".
So I assumed "name check pending" but I as such I have no idea what is happening.. Only guesses...
 
One thing I (And probably most) am unable to understand is - why some 140 cases are approved and why many are left behind pending for the same date of filing? I am sure those that get cleared do not necessarily mean they were more deserving than the ones that were left behind pending.

Is there any link? Does name check has got something to do with it?
Or there are some other system checks that determine what can be processed and what cannot be?

How do we explain many people are waiting more than a year while many who filed in say Oct. have got it approved.

There has to be some funda behind it. Typically, US organizations follow work procedures very strictly. There must be something in the procedures that determines it.

What is that something????

In cases where FBI sends request for overseas namecheck, it needn't follow strict work procedures and whole thing becomes "non-US"
 
My guess is that there are different interpretations among CSC officer on a concurrent I140/I485 application.

In case your name check is pending there is two scenario:

(1)- The officer will process I140 on its own merit and eventually issue approval, RFE or denial while I485 is stuck waiting name check.

(2)- The officer will put the two files on hold.

In my case it is scenario (2) which is unfortumnate since there have been memo and court action to avoid scenario (2) :mad:
