CA NON-RIR Did'nt make it to Regional

Did anyone whose application was filed in NON-RIR(TR) and didnt make it to the Regional ever get any recruitment instructions from Dallas BEC?
I see that Dallas BEC is starting to process NON-RIRs but only those who made it to the regional.

Here are my details:
EB2/NON-RIR/ IT position
State: CA-SWA
PD: 08/2002
RD: did not make it
45-Day Letter Recd: 01/2006
45-Day letter Replied: 01/2006

I am curious to see what procedures BEC is going to follow for recruitment. Maybe they will process ADS/recruitments efforts done for similiar positions because the result would not different for the region.

Any insigts guys???

Hi there,

My case never made it to regional.
Do you mean to say that they will do all recruitment efforts and not like Rir
we need to give advertisment and all. Right? I remember I read somewhere that thsoe procedures our empoyer has to follow. which is kind of odd.

My job is IT related too. Well your response is highly appreciated.
 
they are saying that all non-RIR cases with PD prior to aug 2001 will be treated as RIRs if the employer has a pattern of recruitment.

What the BECs might do:

1) finish all the pending nonRIR cases that have already made to regional
2) finish the pre aug 2001 cases that never made it to regional as RiRs.
3) Once these are done I am guessing they will keep the pushing forward the non-RIR to RIR conversion cutoff date and process remaining aplications as RIRs if possible.

This is all conjecture. Looks like a long process.

Sorry to be vague on the date but the 45-day was dated 12/27/2005 while attorney received the letter 01/03/2006 and replied back on 01/04/2006. Hope this helps in estimating your 45-Day letter.
 
From what I see in this forum you seem to be right. Please see additional analysis for each of the catogories below.

No data on this. I guess very cases most of them should be remanded cases

That does seem far fetched. The prior conversion was to encourage the new RIR system back when RIR was put in place. BUt now the new system is PERM and they would rather ask to move in that. Again very unlikely as we have seen from horror stories!.

This is all conjecture. Looks like a long process.
